Vidhan Sabha or Legislative assembly is the Lower House of the state legislature, in different states of India. There is a Vidhan Sabha President and by the order of him/ her work procedure is supposed to be done. The members of the Legislative assembly attend the proceedings in order to assure smooth procedural functioning of Vidhan Sabha. Members of a Vidhan Sabha are direct representatives of the people of the particular state as they are directly elected by an electorate.

Orientation: – The state legislative assembly i.e. Vidhan Sabha consists of the MLA’s from different constituencies just like the Lok Sabha of the Lower House of parliament has MP’s. Parliament determines central government but state legislative assembly determines state government.

Role of the Assembly: – The most important function of the Legislative assembly is to act as the highest law making organ of the state. The chief minister as well as the other cabinet ministers is collectively responsible to the Assembly. As the Assembly does not have a direct share in the executive powers; it has a good degree of influence over the executive.

Powers of the Assembly: – The Assembly has powers over the state purse. The budget and indeed all financial bills are initiated in and passed by the assembly with the previous sanction of the Governor. The council in bicameral legislatures may only delay a money bill by 14 days. The Assembly also has some exclusive powers where only MLA’s take party in the election procedure of the President. Only Assembly ensures the constitution amendments where; approval by state legislature is a constitutional requirement. Reports of Public Service Commission and Comptroller and Auditor General are also considered by Vidhan Sabha.

Limitations: – The Assembly also suffers from some limitations wherein it has no powers to initiate amendment proposal, the laws passed by the Assembly are subject to judicial review, and bills passed by the Assembly may be rejected or reserved for the President’s assent by the governor.

Term: – The term of the Legislative Assembly is of five years but it may be dissolved even earlier than five years by the governor on the request of Chief Minister.

Qualifications to be a member: – With no criminal background and to be absolutely sound in mind one has to make sure he/she passes through all of these criteria to be an eligible member of the Vidhan Sabha. Basically a person must be not less than 25 years of age and should be a citizen of India and has no claim to bankruptcy.
